Recorded Session Terms and Conditions
The following terms and conditions explain the rights and responsibilities of both the applicant and the host. For the purposes of this document, ‘the guest’ or ‘the applicant’ applies to the person invited by Liberation Academy or Helen Villiers to appear on ‘The Liberation Effect’ or ‘Hub Bytes’.
The applicant acknowledges that the fee of £125 is available on the grounds that the session may be used as an episode of ‘The Liberation Effect’ and as such should they assert their right to withdraw consent to publication they will be charged the remaining £375 of a standard Immersion Session.Â
1. Grant of Rights and Use of Likeness
1.1 Use of Likeness:
In the case where a guest is participating as a public person, the guest grants Liberation Academy Ltd the perpetual, worldwide right to record, use, and distribute their name, voice, image, and likeness as part of the podcast episode. This right includes the use of the Guest’s likeness in promotional materials, on social media, and across any platform where the podcast may be distributed. Where the guest is an applicant for an anonymous recorded session, their voice will be altered and image removed and not used on social media for promotion in it’s original form.

1.2 Content Ownership: All content created during the podcast recording—including audio, video, and any derivative works—is the sole property of Liberation Academy Ltd. The Company reserves the right to edit, reproduce, and distribute the content at its discretion.

2. Recording, Editing, and Distribution

2.1 Recording and Editing: The Guest consents to have their voice, statements, and participation recorded in audio and/or video format. The content may be edited for clarity and length.

2.2 Distribution and Archiving: The Guest agrees that the recorded content may be distributed across podcast platforms, streaming services, websites, and third-party platforms. The content may also be used in promotional materials and archived for future reference.

2.3Â Liberation Academy reserve the right not to use the recording for the podcast without explanation.

3. Content and Discussion Topics

3.1 Subject Matter: The session may involve discussion of personal experiences, including but not limited to topics such as trauma, abuse, neurodiversity or mental health challenges.

 Guest Controls:

 The Guest has the right to
- Refuse to answer any questions.
- Request that names or events that are uniquely identifying be avoided or removed from the final edit.
- Pause or stop the recording at any time. But in doing so agree to pay the remaining £375 for a standard Immersion session.
- Withdraw consent for publication up to 72 hours before the scheduled release with the incurrence of the remaining £375 for a standard Immersion Session.
 4. Personal Responsibilities, Legal Considerations, and Consent
4.1 Voluntary Participation: The Guest confirms that their participation is entirely voluntary and that they have considered the potential personal and professional impacts of sharing their story.

4.2 Legal Capacity: The Guest affirms that they are legally able to share the information discussed and have secured any necessary professional advice (legal, mental health, etc.) prior to participation.

4.3 Support Systems: The Guest acknowledges that they have appropriate emotional and practical support systems in place for any issues that may arise during or after the recording.

4.4 Disclosure Responsibility: The Guest agrees not to name alleged abusers or disclose sensitive information without prior legal consultation and confirms awareness of potential defamation and privacy concerns. The Guest is responsible for ensuring that their disclosures do not violate any existing legal agreements.

5. Public Liability and Release of Liability

5.1 Public Access: The Guest acknowledges that the podcast is published on public platforms and may be accessible to a broad audience, including individuals personally known to them. While reasonable efforts will be made to maintain anonymity upon request, absolute confidentiality cannot be guaranteed.

5.2 Assumption of Risk: The Guest voluntarily participates in the podcast and assumes all risks -including emotional, psychological, and personal consequences -arising from their participation.

5.3 Release: The Guest hereby releases and discharges Liberation Academy Ltd, its directors, employees, agents, producers, and affiliates from any claims, demands, or causes of action related to the recording, editing, distribution, or future use of the recorded content.

6. Confidentiality

6.1 Confidential Information: The Guest agrees to keep all details regarding the podcast episode- including content and the recording process -confidential until the episode is publicly released by Liberation Academy Ltd. No confidential information shall be disclosed to third parties without the Company’s prior written consent.

7. Right to Withdraw
Â
7.1 Pre-Recording Withdrawal: The Guest may withdraw from participation at any time prior to the recording by providing written notice to Liberation Academy Ltd at enquiries@liberationacademy.co.uk. Where the withdrawal is made less than 72 hours prior to recording the guest agrees to pay the remaining fee of £375 for a standard Immersion Session.

7.2 Post-Recording Finality: Once the podcast episode has been recorded, the Guest acknowledges that they have no right to withdraw or revoke consent for the use of the recorded content, except for publication consent which may be withdrawn up to 72 hours before the scheduled release.

8. Crisis Response Procedure
Â
8.1 Immediate Response: In the event that the Guest exhibits signs of distress during recording, the recording will be paused immediately. Grounding techniques will be implemented, and the Guest will be offered a break to regulate. If a support person is available, they will be contacted. The recording will only resume once the Guest provides explicit consent to continue.

9. Guest Suitability

9.1 Assessment: The Guest acknowledges that their suitability for participation in the podcast is subject to assessment by Liberation Academy Ltd, which reserves the right to decline participation at its sole discretion.

10. Governing Law
Â
10.1 Jurisdiction: This agreement shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from this agreement shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Acknowledgement and Acceptance
By clicking ‘I agree to the terms and conditions’, the Guest confirms that they have read, understood, and agree to be bound by the terms and conditions outlined in this agreement. The Guest also represents that they are over 18 years of age and have the legal capacity to enter into this agreement.
